Summary

Coupled with the new federal wetlands delineation manual and tougher wetlands enforcement practices over the last few years, the controversial Memorandum of Agreement on mitigation and the U.S. Army Corps of Engineers has proven to be the last straw for many in the economic and natural resources development communities. The American Association of Port Authorities, however, has found few surprise and little new in the MOA. In fact, the MOA may lead to improvements, both environmental and administrative, to the quite complicated Federal Water Pollution Control Act §404 dredge and fill program.
