Summary

For the responsible developer, mitigation is becoming an increasingly less attractive means of reconciling conflicts between habitat preservation and development. For many developers, litigation- even protracted litigation- is the preferable, and less expensive, alternative. One wonders whether this drift toward confrontation and away from compromise is truly in the public interest.
