West Virginia v. EPA: Analyzing the Supreme Court’s Decision

The Supreme Court will soon be releasing their decision on the landmark West Virginia v. EPA case. This important case involves the powers delegated to the Environmental Protection Agency (EPA) to regulate greenhouse gas emissions through Section 111(d) of the Clean Air Act. In addition to the environmental implications, the decision may address broad principles of administrative law potentially affecting the manner in which Congress can delegate regulatory authority to all federal agencies. The Environmental Law Institute gathered experts in March to assess the oral arguments.
