It includes a focus on special business considerations when this technology is involved and concludes by discussing the development of an effective environmental governance structure for nanotechnologies that protects human health and the environment without stifling the development of this new field.

About the Author

Lynn L. Bergeson is Managing Director of Bergeson & Campbell, P.C., a Washington, D.C. law firm, and President of The Acta Group, L.L.C. and The Acta Group EU, Ltd., Bergeson & Campbell’s consulting affiliates. Ms. Bergeson concentrates on conventional and engineered nanoscale chemical, pesticide, and other specialty chemical product regulation and approval matters, domestic and foreign chemical classification, chemical product litigation, Food and Drug Administration-regulated product approval, and associated business issues. Ms. Bergeson counsels clients on health, safety, science policy, and related legal and regulatory aspects of traditional domestic chemical regulatory programs under the Federal Insecticide, Fungicide, and Rodenticide Act and the Toxic Substances Control Act, as well as on issues pertinent to nanotechnology and other emerging transformative technologies.

Ms. Bergeson is a graduate of Michigan State University (B.A., magna cum laude), and the Columbus School of Law, Catholic University of America, where she was a member of the Catholic University Law Review.

Tracy Hester heads the environmental law section of the Houston office of Bracewell & Giuliani L.L.P. Mr. Hester assists clients in regulatory counseling with an emphasis on enforcement defense, environmental permitting, and cost recovery litigation. He also provides advice on the application of environmental law to emerging technologies, including nanotechnology and alternative energy sources. He has represented clients from diverse industrial sectors, including petrochemical manufacturers, petroleum and natural gas pipelines, petroleum refineries, utilities, wind energy, nanomaterials fabrication, hazardous waste disposal operations, and financial institutions. Mr. Hester has represented companies and local governments in litigation or compliance negotiations on ozone regulatory policy and total maximum daily load water quality projects. He also assists companies with emergency response planning and security assurance legal requirements.

Mr. Hester received his J.D. from Columbia University School of Law and his B.A. from the University of Texas at Austin.
