This law establishes that a new school receiving state public school construction funds must be constructed as a high performance building. The law defines a high performance building as one that meets the LEED Silver rating or a comparable rating of another nationally-recognized standard approved by the state. The law established that, from 2010-2014, the state would pay 50% of the local share of the increased costs of constructing the school to meet the new standard. The law also directed the Interagency Commission on School Constructiont o adopt regulations to implement the law.
