School District Liability for Indoor Air Quality Conditions: A Review of Selected Legal Issues. The past several years have seen a notable increase in the number of lawsuits related to indoor air quality (IAQ) problems. A significant number of these cases have involved IAQ conditions in school facilities. This report analyzes legal issues that arise in IAQ-related claims brought against public school districts by parents or school staff in three areas of the law: state workers’ compensation schemes; common law tort; and federal disability rights/non-discrimination statutes. The report presents an overview of statutes and court decisions in these areas, and provides a general sense of how these cases have been resolved to date.
