EPA Refers Proposed Corps NEPA Procedures to CEQ

On February 25, 1985, the Environmental Protection Agency (EPA) took an unusual action pursuant to its environmental review authority under the National Environmental Policy Act (NEPA) and Section 309 of the Clean Air Act. Stating that the U.S. Army Corps of Engineers’ proposed NEPA procedures, 49 Fed. Reg. 1387 (Jan. 11, 1984), “would have unacceptable effects on the quality of the environment,” EPA for the first time asked the Council on Environmental Quality (CEQ) to resolve a dispute over a federal agency’s proposed rulemaking.
