Summary

Mitigation has been. for a number of years, an integral part of the Army Corps of Engineers Regulatory Program implementing §404 of the Clean Water Act and will continue to play an instrumental role in permit decisions. The Corps Regulatory Program, once limited to protecting navigation interests, today considers the full public interest by balancing the benefits of a proposed project against its reasonably foreseeable detriments. The Corps' assessment of the public interest consistent with national priorities examined the beneficial and detrimental impacts of a variety of factors.
