Summary

A major test of the Environmental Protection Agency (EPA) wetland protection authority under Section 404 (q) of the Clean Water Act is being closely watched in Maryland this year. The permit in question is the Maryland Department of Natural Resources (DNR) application of Army Corps of Engineers for construction of a 45 foot earth fill dam on the main branch of the St. Mary's River. The purpose of the dam is to provide freshwater swimming opportunities for residents and visitors in rural St. Mary's County in Southern Maryland.
