Following the U.S. Supreme Court's 1995 decision in United States v. Lopez, holding that the Gun-Free School Zone Act exceeded congressional Commerce Clause authority, it was widely known that the Clean Water Act's Section 404 program was potentially vulnerable to a similar constitutional change. Apparently, however, no one told the Corps of Engineers.
