Summary

“Property” connotes ownership. The purported characteristic of ownership that one may use his property as he sees fit has been the philosophical linchpin of every challenge to a restriction on the use of property. Policy makers must gauge the relative strength of this philosophical position vis-à-vis society’s need for restrictions on the use of property. Wetlands are a prime example of this phenomenon.
